1. Agreement and scope
These Terms of Service ("Terms") are an agreement between you and Crescendo Piano LLC ("Crescendo," "we," or "us"). They apply to the public Crescendo website, its browser games, and the currently released Crescendo Piano Android app (together, the "Services"). Unreleased development builds are outside this public agreement.
By downloading, accessing, or using a Service, you agree to these Terms to the extent permitted by law. The current Services do not present a Terms checkbox or electronic-signature flow, and these Terms do not claim otherwise. If you do not agree, do not use the Services.
Google Play's terms and policies also apply when you obtain the Android app through Google Play. If a store term conflicts with these Terms about a store-controlled transaction, the store term controls that transaction.
2. Eligibility and families
You must be legally able to agree to these Terms. If you are not, a parent or legal guardian must review and agree to them for you and supervise your use. A parent or guardian who permits a child to use Crescendo is responsible for that use, including permission choices, imported material, and any support message.
The current Services do not ask you to create an account or enter a birth date. These Terms therefore do not rely on an age gate that the product does not implement.
3. Current service
Crescendo provides sheet-music display, import and library tools, practice feedback, local progress and annotation features, device-input support, and browser music-practice games. Features vary by platform, device, permissions, file format, and release version.
The current website and released Android app do not offer a Crescendo account, server-hosted library, or cloud synchronization. A future account or sync feature will require updated product terms and privacy information before launch; these Terms do not grant Crescendo permission to silently upload today's local library or practice history.
4. License and ownership
Subject to these Terms and any applicable store license, Crescendo grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for lawful music practice and learning. You may not sell, sublicense, rent, or commercially exploit the Services themselves.
Crescendo and its licensors retain rights in the Services, including the software, design, branding, and original content. This license does not transfer ownership of those materials to you.
Scores, fonts, libraries, audio, and other third-party materials can have separate licenses or notices. Those terms continue to apply. Crescendo does not claim ownership of a score or file merely because you import it.
5. Your files, links, and exports
You are responsible for ensuring that you have the rights and permissions needed to import, download, display, modify, practice from, export, or share a score or other file. Do not use Crescendo to infringe copyright, bypass access controls, or obtain material unlawfully.
Local processing does not make an unauthorized copy lawful. Import from URL sends a request to the address you provide and may follow redirects; you are responsible for the source and the link. Files supplied through Discover or bundled with the app remain subject to the notices and licenses identified with those files.
When you choose an export or share action, your device hands the selected material to the destination you choose. Crescendo does not control that destination, its recipients, or later copies.
6. Android purchase
At this Terms version's publication date, the public Android app is offered as a paid Google Play download. The current price and availability are the amounts shown by Google Play for your account and region at purchase time.
Google processes the transaction. Payment methods, taxes, cancellations, refunds, family-library access, and license verification are governed by Google Play's terms, its refund policy, and applicable law. Nothing in these Terms removes a non-waivable consumer right.
7. Acceptable use
You may not:
- use the Services unlawfully or to infringe another person's rights;
- interfere with, overload, probe, attack, or evade security or rate limits on the website, Discover service, or another network feature;
- introduce malware, malicious files, or code intended to harm a device or service;
- misrepresent affiliation with Crescendo or use Crescendo branding in a misleading way;
- reverse engineer or circumvent technical protections except where applicable law expressly permits it;
- use automated access in a way that disrupts the Services or ignores published technical controls.
8. Third-party services and content
The Services can interact with Google Play, Firebase, browsers, operating systems, MIDI or Bluetooth devices, file providers, music-library servers, email applications, and URLs you select. Those products are provided by others under their own terms and privacy practices.
Crescendo is not responsible for a third-party service's availability, security, content, or conduct. A link or interoperability feature does not mean Crescendo endorses every item available through it.
9. Privacy
Our Privacy Policy explains current data practices, including local storage, Android analytics and consent controls, microphone and MIDI processing, network imports, retention, and deletion controls. It is incorporated into these Terms by reference.
10. Changes and availability
We may fix, update, add, remove, or discontinue a feature or Service. We do not promise that every file will import correctly, every MIDI device will interoperate, a third-party catalog will remain available, or the Services will be uninterrupted.
We may update these Terms when the product, providers, or law changes. The current version will be published at /terms, with prior versions in the legal archive. We will provide additional notice or obtain consent when law requires it. Changes apply from their stated effective date, not retroactively unless law permits and the notice says so.
11. Disclaimers
Crescendo is a practice aid, not a substitute for professional music instruction, hearing care, medical advice, or safe playing technique. Learning results depend on many factors, including the user, instrument, material, device, and practice.
To the maximum extent permitted by law, the Services are provided "as is" and "as available." Crescendo disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not exclude warranties that law does not allow us to exclude.
12. Limits on liability
To the maximum extent permitted by law, Crescendo and its officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption arising from the Services.
To the maximum extent permitted by law, Crescendo's total liability for a claim relating to a paid Service will not exceed the amount you paid for that Service. These limits do not apply to liability that cannot lawfully be limited, and some jurisdictions may give you additional rights.
13. Ending use
You may stop using the Services at any time and may remove local data using the controls described in the Privacy Policy. Uninstalling does not withdraw an email already sent, erase a user-created export, or automatically delete Analytics events already received by Google.
We may restrict access to network services if reasonably necessary to address abuse, security, legal requirements, or a material breach of these Terms. Sections that by their nature should survive—including ownership, disclaimers, liability limits, and dispute terms—remain effective after use ends.
14. Governing law and disputes
These Terms are governed by Arizona law, without regard to conflict-of-law rules, except that mandatory consumer protections in your home jurisdiction continue to apply. Before filing a formal claim, please email legal@crescendopiano.app with enough detail for both sides to try to resolve it informally.
Unless applicable law requires another forum, a court with jurisdiction in Maricopa County, Arizona will be the forum for a dispute. These Terms do not impose mandatory arbitration, a class-action waiver, or an arbitration opt-out process that the current product has not presented to users.
15. General terms
These Terms and the Privacy Policy are the agreement about the Services described here. If one provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision once is not a waiver.
You may not transfer these Terms without our consent. Crescendo may transfer them as part of a merger, acquisition, reorganization, or sale of the relevant business, subject to applicable law. Headings and summaries are for readability; the full text controls.
